- RULES (LEASE) for Guests/Tenants Definitions: Guest/Tenant - Guest or Tenant of Apartment #2 in Beach Ridge Apartments Landlord - Landlord and owner of Apartment #2 in Beach Ridge Apartments or his representative. Association - Beach Ridge Apartments, Inc. and any of its authorized representative, officer or agent such as management company. Subject: Guest/Tenant rents Apartment #2 in Beach Ridge Apartments as a vacation rental under the terms displayed below and terms and rules of a Landlord's partner or intermediary like online platforms and sites, if any, paying the rent to Landlord directly or indirectly in the amount and for a term agreed by parties before check-in. Please, pay special attention to highlighted text! 1. CHECK-IN: In case of self-check-in Guests/Tenants when arrived must check in by notifying Landlord within 1 hour after coming into the apartment via text, email or Airbnb. 2. SMOKING: Smoking inside of the apartment is strictly prohibited, smoking is allowed outside only and please pick up butts. Guest/Tenant may lose the deposit in case violation of this rule. 3. APARTMENT APPEARANCE AND MAINTAINENCE: a). To maintain the high caliber of the exterior appearance of our building and grounds, no laundry, articles of clothing, cleaning materials, etc. are permitted anywhere outside the apartment. b). While Guests/Tenants are out of the apartment, all the lights, TV-sets and other appliances except refrigerator, AC and water heater must be turned off. c). Guests/Tenants must use the appliances in the right way (don't leave the refrigerator door open when it is turned on etc.). d). Guests/Tenants must keep windows and doors closed all the time while AC is working not letting warm air inside the apartment. 4. NOISE: It is expected that Guests/Tenants will be considerate of their neighbors and refrain from disturbing noises at all times. No boisterous conduct or unreasonable noises are permitted. Yelling and screaming by children should be curbed by parents or their responsible adult. Radio, stereo and TV sets should be turned low, particularly if the windows are open. Exterior cell phone conversations should be moderated and not disrupt others(URL HIDDEN)5. NUISANCES: No nuisance, use or practice shall be allowed on the property which is a source of annoyance to the other residents. All parts of the property shall be kept clean and sanitary, and no rubbish, refuse or garbage allowed to accumulate, nor any fire hazard allowed to exist. 6. OVERNIGHT GUESTS & MAXIMUM OCCUPANCY: Overnight guests of the Guest/Tenant in the property not authorized by Landlord is the sole responsibility of Guest/Tenant and may be removed by Landlord. According to Ordinance of City of Fort Lauderdale No. C-15-29, Sec. 15-278, Paragraph 2, the occupancy of this apartment (which living area is 792 Sq.Ft) must not exceed 5 persons. -1- 7. GARDEN AND SWIMMING POOL AREA: Use plastic glasses or dishes only in pool area. Personal belongings must be removed when leaving garden or pool area. When using a table with an umbrella be sure the umbrella is closed before leaving. Return all furniture to its designed location and position after use. 8.SWIMMING POOL RULES: a). Hours are from 8:00 AM to 10:00 PM. b). The pool is for the exclusive use of apartment owners and their guests. The Guest/Tenant must be present and assume full responsibility and liability for his/her guests. c). All persons using the pool do so at their own risk. d). All persons must take a shower before entering the pool, using the pool side shower for your convenience. e). No person shall be allowed in the pool, to sit, or to lie, in the area around the pool with oil, grease or other preparation applied to the skin without first covering such areas or chairs with a towel or covering. Use of the pool with such a lotion is definitely prohibited. f). Any person with hair longer than shoulder length must wear a bathing cap. g). No person, having any infectious/communicable disease is allowed in pool. h). Children under the age of 12 must be accompanied by an adult. i). No person shall conduct himself in such a manner as to jeopardize the safety of him/herselfor others. j). Bathers must leave the pool during thunder and lightning storms. k). One raft at a time is permitted in pool because of the size of said pool. Other people must be able to swim freely. l). No articles shall be thrown in the pool or pool area. m). No diving, running, jumping or games, etc. allowed in pool or pool area. n). Management reserves the right to deny the use of the pool to anyone at any time for violation of any rule. o). Any individual wearing diapers, must wear plastic pants over their diapers while in the pool. p). Pets are not permitted in the pool area. 9. CHILDREN: a). Guests/Tenants must assume full responsibility for the care and protection of children brought onto the grounds or into the building, either by themselves, or by their guests. Guests/Tenants are fully responsible for any damage that may be done by the children. Children are not permitted to run up and down stairs and balconies, or in any way interfere with the quiet and comfort of the residents. They may not yell, scream and be noisy at their play. b). No children under the age of 18 are permitted to occupy the apartment unless their parent or other responsible adult is in residence at the same time. 10. STORAGE: Passageways must always be clear of any obstructions. There are not to be any items, lawn chairs, etc. stored underneath any stairwells. Bicycles are permitted in the bicycle rack located behind the laundry building next to outdoor cooking units and under the stairwell of the small building. 11. AUTOMOBILE PARKING: Each apartment is assigned one parking space on the premises. The assigned space for Apartment #2 is marked under letter “P” (the furthest spot to the right). Guest/Tenant should park his/her automobile in the assigned space front first. Do not back in. Automobiles parked in unassigned spaces should display conspicuously on the dashboard the apartment and contact number for the operator of the vehicle. Should the operator of the vehicle not be available when contacted to move their car, the car is subject to immediate towing with all costs involved to be borne by the owner of the vehicle. Commercial vehicles, Boats, Trailer, R.V., oversized vehicles or motorcycles are not permitted on the property. -2- 12. LAUNDRY FACILITIES: Rules are posted in the laundry room. (a) Lint filters are to be cleaned by user after each use. No tints or dyes shall be used in the washing machine. (b) Each user is responsible for leaving the machines and room in a completely clean condition. (c)Laundry hours are 8:00 AM to 10:00 PM. This means your laundry must be finished and removed before closing time. 13. TRASH: Trash must be placed in plastic bags and boxes must be broken down before placed in dumpsters(URL HIDDEN) 14. AUTOMOBILE WASHING: Owners or Renters are allowed to wash one car a week. Water usage is subject to governmental regulations(URL HIDDEN) 15. PETS: Only one (1) small domesticated housebound pet that does not exceed 20 lbs. in weight, thatis well behaved and that does not annoy other cooperative residents will be allowed. A pet is defined as only an indoor dog, cat, or fish in a tank up to a size of 25 gallons. It specifically is not any type of exotic pet, bird or any other type of animal. The landlord or Association Board shall have the right to require any pet to be removed from the premises which does not comply and adhere to these rules: (a) To keep the pet from causing any annoyance or discomfort to others and to immediately remedy any complaints concerning the pet. (b) To keep the pet from damaging any property belonging to the Association, landlord or others. (c) To immediately pay for any injury, damage, loss, or expense caused by the pet. In this regard, it is expressly understood that at no time shall the Guests/Tenants apply any part of the Pet Deposit towards such amounts due, but rather, the Guest/Tenant shall make restitution immediately and separately from the Pet Deposit. (d) To keep the pet under control at all times. (e) To carry or walk on a leash the pet, but not tethered, when it is outside of the apartment. (f) To keep the pet on the walkways and not allow the pet in the pool area or on the common area grass at any time. (g) Not to leave the pet unattended for any unreasonable periods. (h) To hold the Association and Landlord harmless from all liability arising from the Guest/Tenant’s ownership or keeping of the pet. (I) To dispose of the pet’s droppings properly and quickly. (j) To insure that pet will wear the appropriate Animal License, a valid Rabies Tag and tag bearing the owners name and phone number. All licenses and tags must be kept current. (k) To provide the Association or Landlord with evidence from the Veterinarian that all necessary shots are current and that the pet does not display a tendency to be aggressive or harmful. (l) Guest/Tenant agrees that Association and Landlord will not be responsible for the injury, harm, or deathof the animal, and agrees to hold Association and Landlord harmless for any damages suffered as a result of any harm caused on the animal or by the animal upon another person, guest or employee. Guest/Tenant shall be responsible for the entire amount of all damages caused by the pet as well as the entire amount of any injury to individuals or property. (n) Pet must be spayed/neutered. (o) Pet shall not create any conflict or disturbance with others and will not threaten any physical harm to anyone. (p) No food shall be set out on association property for any animal, either pet or stray. Shouldthe Guest/Tenant fail to comply with any part of these Pet Rules, the Landlord or Association reserves the right to revoke permission to keep the pet on the premises. In such event,the Guest/Tenant -3- agrees to permanently remove the pet from the premises within 24 hours of receiving notice thereof from the Landlord or Association. 16. VIOLATIONS, RESPONSIBILITY, RULES ENFORCEMENT and LOSS OF DEPOSIT: a). According to Ordinance of The City of Lauderdale No. C-15-29, Sec. 15-273, Paragraph (5)e, Guest/Tenant acknowledges that he/she may be evicted for violation of these rules (lease) and: That if he/she, without being authorized or invited, willfully enters or remains in the structure or conveyance of the property, or, having been authorized or invited, is warned by Landlord to depart the property and refuses to do so, commits the offense of trespass in the structure or conveyance. b). Violations of rules by Guest/Tenant and children will be the Guest/Tenant’s responsibility. If sanctions for such violations are imposed on the Landlord and if necessary, enforced in a court of law with all related administrative, attorney and court costs, the violating Guest/Tenant must reimburse all expenses incurred by the Landlord. c). Guest/Tenant may forfeit deposits for any damages suffered by Landlord and caused by the Guest/Tenant. d). The owner is not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The owner is not responsible for the loss of personal belongings or valuables of the guest/tenant. It is agreed that all Guests/Tenants are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise(URL HIDDEN) -4-
