SHORT TERM LEASE AGREEMENT
By this Lease Agreement, High Noon Ltd, or Agent for the Lessor of the above premises, agrees to lease to Lessee and Lessee agrees to lease from the Lessor, the above residential premises upon the following terms and other charges as set forth in the (SENSITIVE CONTENTS HIDDEN) Quote:
Term: The Term of the Lease shall commence at FOUR PM on the arrival date and shall expire at TEN AM on the date of departure. During your stay, you are required to maintain the cleanliness of the premises. When you leave, please return the premises to a presentable condition. Lessor and their agent are not responsible for articles left behind. Please check all drawers and closets carefully prior to departure.
Keys will be picked up at the property or Real Estate office on the day of check in unless other arrangements are made due to late check in after office hours. There is an information book about the property at the premises. The Lessee’s are obligated to read the information book and abide by the rules and guidelines of the premises, failure to do so my results in loss of the security deposit.
Occupants: Lessee agrees to use the Premises solely as a private residence for occupancy by no more than 16 overnight residents and no other persons without the prior written consent of the Lessor. Lessee agrees to maintain the Premises in a clean sanitary condition at all times, to commit no waste, to engage in no unlawful conduct therein, and to observe all applicable laws, rules, regulations, and ordinances affecting the Premises and the use thereof.
Use and Occupancy: The premises shall be used and occupied by the Lessee exclusively as a private residence. Lessee shall further: not obstruct or permit to be obstructed the sidewalks, drives, walkways, hallways or parking areas of the premises; cause any damage to the exterior of the premises. A parking area will be accessible to the Lessee. The lessee shall make no unreasonable noise or create any unreasonable interference with the neighbors. The violation of any provision of this paragraph shall be deemed a breach of this Lease.
Services: Please store trash in covered barrels and recyclables in containers provided until pickup day. Recyclables & trash barrels are placed at the parking area in front of the tennis courts for pick up on Monday mornings.
Damage: Lessee shall inform Lessor or Agent of any damage found during the term of Lessee’s occupancy.
Injury: Lessor and/or Agent shall not be liable to Lessee, guests, invitees, licensees or any other person for any injury, loss or damage to any person or property on or about the premises. Lessee shall hold Lessor and/or Agent harmless and indemnified from and against all loss or damage occasioned by the misuse or abuse of any part of or fixture on the premises, and from and against any and all loss, damage or liability arising from any omission, neglect or default of Lessee, guests, invitees, or licensees.
Uninhabitable: In the event the premises become uninhabitable prior to the lease start date for any reason (i.e., fire or hurricane), Lessor agrees to refund the full rent payment if no other premises, acceptable to the Lessee, are available, and this lease shall be null and void upon such notification. If the premises become uninhabitable during the lease term, for reasons other than Lessee's fault or neglect, Lessor agrees to refund the unused portion of the lease. Lessor and Lessor’s Agent shall be held harmless.
Pets & Smoking: In limited cases Pets are allowed in and on the premises. The pet’s weight, size and breed must be disclosed to High Noon Ltd or the Agent. The pet must be flea and tick treated, all dog waste must be removed from the yard daily. Pets are not allowed on the beds or furniture. Smoking is not permitted in the house.
Use, Quiet Enjoyment and Local Laws: The Lessee will use the premises in compliance with all laws and ordinances applicable thereto. Lessee will specifically agree to abide by all municipal noise ordinances, recycling rules and any and all rules and regulations of the property as defined by the Town of Lessor. Lessee indemnifies Lessor against and agrees, on demand, to pay all penalties or fees for any violation attributable to Lessee, Lessees family, agents, employees, invitees, guests, and/or any person on the property through or under the Lessee.
Functions: Lessee agrees to maintain a quiet and decorous behavior for themselves and guests during the duration of this Lease. No fireworks shall be erected on the Premises without the prior written consent of the Lessor. The violation of any provision of this paragraph shall be deemed a breach of this Lease.
Cleaning: By this Lease Agreement, Lessor of the above premises agrees to wash dishes and place the trash in designated area for pick up.
Holdover: Lessee may not hold over beyond 10am of lease expiration period without written consent of the Lessor.
Prospective Lessees: Lessor and or Agent will have the right to enter the premises in the case of emergency.
Beach Use, Dock Use, Hot Tub Use: If the house is located on the shoreline. There is no lifeguard in attendance at the Premises. The use of the beach, dock, hot tub if applicable is at the Lessees’ sole risk. LESSEES FULLY UNDERSTANDS that: (a) USE OF THE BEACH, DOCK & HOT TUB INVOLVES RISKS AND DANGERS of serious bodily injury, including permanent disability and death ("Risks"); and (b) these Risks and dangers may be caused by Lessees’ own actions, or inactions, the actions or inactions of Lessees’ guests, or the negligence of others; and LESSEES FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR INJURIES, LOSSES, COSTS, AND DAMAGES that they incur as a result of use of the beach. LESSEES HEREBY RELEASE, discharge, and covenant not to sue Lessor, its owners, members, officers, successors, assigns, administrators, executors, or heirs, from all litigation, liability, claims, demands, injuries, losses, damages, costs and expenses arising out of or relating to the use of the beach by Lessee or its guests, invitees or licensee; and LESSEES WILL INDEMNIFY, SAVE, AND HOLD HARMLESS Lessor, its owners, members, officers, successors, assigns, administrators, executors, or heirs, from any litigation, liability, claims, demands, injuries, losses, damages, costs and expenses which any may incur as a result of such claim.
