Guests will be required to sign a rental agreement outside of AirBnB at least 7 days prior to arrival (if booked in advance of 7 days).
1.In the event of any life-threatening emergency or emergency that requires the assistance of Police or Fire Department : DIAL 911
2.Smoking is not allowed inside the home. If you smoke inside the home, your deposit will be forfeited.
3.People other than those in the Guest party set forth above may not stay overnight in the property. Any other person in the property is the sole responsibility of Guests.
4.The Property is privately owned; The Homeowner is not responsible for any accidents, injuries, illness, or deaths that occur while on the premises or its facilities. Guests acknowledge that the Property is not child or infant proof; the safety of children and visitors is the sole responsibility of Guests.
5.Guests agree to notify the Homeowner upon check-in or within 24 hours of check-in of any housekeeping complaint or property maintenance issue. Failure to do so precludes any courtesy consideration. If the Property is damaged as a result of failure to report a maintenance issue at any time, Guests may be held liable.
6.Please call the Homeowner for routine or emergency maintenance.
7.Damages over above deposit amounts may be charged to the credit card on file or AirBnB.
8.In the event of breach under this agreement, the losing party agrees to pay reasonable attorney fees.
9.Keep the Property and all furnishings in good, clean order.
10.Only use appliances for their intended uses.
11.If police are dispatched for false (house) alarm, the credit card on file may be charged or deposit deducted in the amount of any fine imposed.
12.Pets are permitted only with prior approval and the Pet Addendum must be completed.
13.Housekeeping: There is no daily housekeeping service. Rentals over one week will require weekly housekeeping. Details of days/times may be arranged on a case by case basis. The Property is rented with the understanding that Guests will leave the property in reasonably the same condition as found at check-in.
14.Hot Tub: Children under the age of 18 are not permitted in the hot tub at any time without adult supervision. When using the hot tub, remember there is a certain health risk associated with this facility. Use at your own risk. The Hot Tub is maintained and cleaned by the same service as that of the pool. The Hot Tub has an high wattage electric heater; when not in use, please set temperature to 80 degrees and replace cover.
15.The Property's bathrooms are furnished with lined trash receptacles. DO NOT FLUSH anything other than toilet paper. No feminine products should be flushed at any time. If it is found that feminine products have been flushed and clog the plumbing system, you may be charged for any plumbing service required.
16.Guests executing The Agreement and occupying The Property must be at least 25 years of age. The Maximum number of Guests is limited to 8 persons (6 adults), per Palm Springs City Ordinance NO. 1918. Undisclosed Guests will result in loss of rental fees paid, complete forfeiture of security deposit, and all guests being immediately evicted. Guests that disturb the peace and quiet of neighbors, Guest that receive any noise complaints and/or Guests that are visited by police due to complaints, will be immediately evicted with no refund of rental fees paid and will forfeit entire security deposit.
17. Outdoor speakers and music are not permitted.
RESPONSIBILITY: Tenant hereby assumes all risk of damage to any and all personal property of Landlord and Tenant, including household furniture and goods during such use and occupancy. Tenant hereby assumes any and all risks associated with the foregoing and agrees to hold Landlord harmless from and indemnify Landlord against the same. PERSON(S) RESPONSIBLE FOR BOOKING STAY AND ACCEPTING PROPERTY KEYS MUST BE AT LEAST 25YEARS OF AGE and will be required to show valid ID at Check-In.
RELEASE OF WAIVER OF LIABILITY: Guest hereby expressly, knowingly and freely assumes all risk of liability of any kind, or for any injury of persons or damage to property of guest or any other person, from any cause whatsoever, foreseeable, or unforeseeable, resulting from the use, occupation or enjoyment of the premises by guest, guest's invitees, dependents, charges, any person holing under guest, persons acting on guest's behalf, and guest hereby releases and discharges the releases ‘Owner’ from all liability, claims, demands, losses, or damages caused or alleged to be caused in whole or in part by the negligence of the releases or otherwise.
